The Reno Air Racing Association Accident Compensation Fund Program (the “Program”) has been implemented as an economical, efficient and timely alternative to litigation to create a process for allocation and distribution of the limited funds available to compensate spectators (or legal heirs of a deceased spectator) who were killed or injured at the National Championship Air Races in Reno, Nevada on September 16, 2011. The Program will be administered and overseen by an independent mediator, Kenneth Feinberg, as the Compensation Fund Administrator. The Program has been created to provide compensation to those who were killed or injured as a result of the accident from a limited available fund of approximately $77 million. The Program is designed to provide eligible claimants prompt compensation while avoiding the costs and delays associated with litigation. The Program will not involve determinations as to liability, and by offering this Compensation Fund Program, neither RARA nor any of the Released Parties admit any liability, nor will they offer or present any evidence to contest their liability. Rather the Program will focus exclusively on the damages suffered by claimants and how to compensate them.

To participate, a claimant must have been present at the event and have been injured as a result of the accident or be a legal heir of a spectator who was killed as a result of the accident. Compensable damages will be based upon Nevada law.
